Is surrogacy halachically acceptable?
August 10, 2004

Question

Has there ever been a surrogate mother in our frum circles? I had a hysterectomy after the birth of my son three years ago and I am dreaming of a surrogate mother giving me the chance of having another baby. Can you direct me as whom to ask such a halachik question and do you know if I am already blessed B”H if such a scenario is allowed?

Answer

We appreciate the sensitive nature of this question.

It is difficult to say how often surrogate motherhood actually happens in frum circles. However, it has become increasingly common for religiously observant women to pursue surrogacy. The halacha is decided on a case-by-case basis.

To discuss this further, we invite you to arrange a personal consultation with a Nishmat Fertility Counselor, a Yoetzet Halacha who has completed additional specialized training in this area. Consultations are free and can take place in person, by phone, or via internet conference.
