Had relations on onah

Question

Hi, my husband and I had all 3 Onot fall on the same night, from sunset to sunrise on motzai Shabbat. We accidentally miscalculated the time of shkiya and were together 10 minutes after the Onah had in fact started. Is this considered a violation of nida resulting in karet? Is there anything specific we should do after this situation has occurred? If my menses do not come during the Onah does this make it somewhat better or is it all the same? Thank you!

Answer

We appreciate the sensitive nature of this question.

According to many halachic authorities, relations on onat haveset are prohibited rabbinically. Even according to those who maintain that this halacha is on a Torah level, it is only for a veset kavua and even then not punishable by karet. Halacha also distinguishes between witting and unwitting transgressions.

It’s clear from what you write that you regret what happened and will do your uptmost to prevent it frpom recurring, essential steps of teshuva. Traditional acts of teshuva include tzedaka and tefilla, which we recommend here.
